On Friday 31 October 1997, Prosecution and Defence motions in the case of Colonel Theoneste Bagosora, a former Director of Cabinet in the Ministry of Defence, will be heard before Trial Chamber 2.

The Prosecution is asking for Orders for Protective Measures for Victims and Witnesses to crimes alleged in the indictment of Colonel Bagosora, while the Defence motion is asking for Orders for the Disclosure of Evidence by the Prosecution.

Colonel Bagosora who is defended by Counsel Raphael Constant from France pleaded not guilty to 4 counts charging him with Genocide, Crimes Against Humanity, and Violations of Article 3 Common to the Geneva Conventions and of Additional Protocol II, during his initial appearance on 20 February 1997.

The accused, who was born on 16 August 1941, in Giciye Commune, Gisenyi prefecture, was arrested in Cameroon on 9 March 1996 and transferred to the Arusha Detention facility on 23 January 1997.

Meanwhile hearing of the joint case of Obed Ruzindana and Clement Kayishema is continuing before the Trial Chamber 2, with an expert witness François-Xavier Nsanzabera, a former State prosecutor, testifying on what took place before, during and after the 1994 genocide in Rwanda.
